SO NO FORMAL PRESENTATION FOR YOU ALL THIS EVENING, BUT I WILL HIT A COUPLE HIGHLIGHTS. AND THEN ALSO TONIGHT WE HAVE ROBIN HARE, WHO'S FROM MINNESOTA RURAL WATER, ANOTHER TECHNICAL EXPERT. SO IF THERE IS ANYTHING THAT I CAN'T ANSWER, SHE'S HERE SO I CAN PHONE A FRIEND AS NEEDED, WHICH IS FANTASTIC. SO LOOKING FORWARD TO WORKING WITH ADAM AND BRANDON AS WE CONTINUE FACILITATING THIS PROCESS FOR YOU ALL. SO JUST A FEW QUICK UPDATES. THE CURRENT WELLHEAD PROTECTION PLAN UPDATE IS DUE OCTOBER OF THIS YEAR. SO OUR INTENT IS TO HAVE EVERYTHING FINALIZED AND THROUGH THE AGENCY REVIEW PRIOR TO THAT OCTOBER TIME FRAME. OKAY. CURRENTLY WITH THE CITY'S 4 MUNICIPAL WELLS, THIS WILL INITIATE THE NEXT 10 YEARS OF THE WELLHEAD PROTECTION PROGRAM. AND FOR THE CITY OF ORONO, LOW VULNERABILITY MEANS YOU DON'T HAVE A WHOLE LOT TO WORRY ABOUT. WE'RE PRIMARILY LOOKING AT WELLS AND LOOKING AT UNSEALED WELLS THAT ARE WITHIN THE VARIOUS DRINKING WATER SOURCE MANAGEMENT AREAS. AND FOR THE CITY, THERE ARE ACTUALLY 2 DRINKING WATER SOURCE MANAGEMENT AREAS. THERE'S A NORTH AND A SOUTH TOTALING APPROXIMATELY 870 ACRES. AND WITHIN THOSE 2 AREAS, THERE IS APPROXIMATELY 39 WHAT WE CALL POTENTIAL CONTAMINANT SOURCES. AND FOR THE LOW VULNERABILITY SYSTEM THAT YOU ALL HAVE. THAT IS PRETTY MUCH JUST LOOKING AT ANY WELLS WITHIN THOSE AREAS OR WITHIN THOSE REGIONS. AS WE LOOK THROUGH AND WHAT THAT LOW VULNERABILITY MEANS, IT JUST MEANS IT TAKES A REALLY LONG TIME. IF SOMETHING HAPPENS AT THE SURFACE LEVEL TO TRAVEL TO THE GROUNDWATER AND POTENTIALLY CONTAMINATE YOUR DRINKING WATER SOURCE. SO THE AQUIFER, AS WE CONTINUE ON, SOME OF THE NEXT STEPS, WILL BE TO PUSH INTO PLAY THE IMPLEMENTATION PLAN. SO THAT'S WHAT THE CITY WILL PRIMARILY BE FOLLOWING OVER THESE NEXT 10 YEARS. AND BECAUSE EVERYTHING WILL BE IN THIS IMPLEMENTATION PLAN, THAT ALSO CREATES AN OPPORTUNITY FOR THE CITY TO APPLY FOR GRANT FUNDING THROUGH THE MINNESOTA DEPARTMENT OF HEALTH TO HELP SOME OF THESE ACTION ITEMS. SO IT COULD BE EVERYTHING FROM UPDATING PUBLIC EDUCATION MATERIALS. IT COULD BE FOR, WELL, SEALING PROGRAMS, THOSE TYPES OF ACTIVITIES AND EVENTS THAT CAN GET GRANT FUNDING THROUGH THE STATE AGENCIES. SO AS FAR AS WE'RE LOOKING AT NEXT STEPS, REALLY LOOKING AFTER TONIGHT'S PUBLIC COMMENT SECTION SESSION AND THE PUBLIC HEARING. SO WE WOULDN'T WORRY AS MUCH ABOUT PRIVATE WELLS OUTSIDE OF THE RIGHT NOW. IT'S GOOD FOR THE CITY TO HAVE THAT RESOURCE AND THAT INFORMATION AND KNOW WHERE THOSE ARE. THOSE ARE ALLOCATED. HOWEVER, FOR ANY WELLS WITHIN THE [INAUDIBLE] THOSE ARE THE ONES, AND I UNDERSTAND A LOT OF THERE'S A LOT OF PRIVATE WELLS WITHIN THE [INAUDIBLE]. NOT EVERYTHING'S ON PUBLIC WATER RIGHT NOW. SO AS LONG AS THE CITY CONTINUES WITH THAT METHODOLOGY PRIMARILY WHAT WE'RE LOOKING FOR IS ANYTHING THAT'S NO LONGER BEING USED OR IS NOT NECESSARY. AND IF THAT CREATES OPPORTUNITY TO SEAL THOSE WELLS. THERE'S JUST ONE LESS WORRY FOR THE THE AQUIFER. YEAH. YEAH. DO YOU GUYS LOOK AT OTHER THINGS THAT ARE FLOWING INTO THE AQUIFER? IS THAT WHERE A LOT OF THE TESTING TAKES PLACE TO MAKE SURE THAT THERE'S NO CONTAMINANTS FROM? I DON'T KNOW FROM THINGS THAT WERE THERE PRIOR OR IS THAT WHAT, WHAT? YES THERE IS. YEAH. THERE IS GROUNDWATER QUALITY MONITORING. AND THAT IS SOMETHING THAT IS DONE BY THE DEPARTMENT OF HEALTH IN CONJUNCTION WITH THE CITY. SO PART ONE OF THE WELLHEAD PROTECTION PLAN REALLY LOOKED AT THAT WATER QUALITY AND WATER WATER QUANTITY. THIS PHASE, THE PART 2 THAT WE'RE ADDRESSING THIS EVENING, IS REALLY LOOKING AT THE POTENTIAL CONTAMINANT SOURCES BASICALLY SUMMARIZING WHAT THE WATER QUALITY HAD BEEN LOOKING AT PREVIOUSLY IN THAT PART ONE PLAN THAT WAS COMPLETED A FEW MONTHS BACK. AND THEN ALSO THAT IMPLEMENTATION ITEMS MOVING FORWARD AND HOW WE CAN GET THE CITY SUPPORTED THROUGH GRANT FUNDING AND OTHER OPPORTUNITIES. OKAY, GREAT. THANK YOU. THEY PUT THE $75,000 EIS LEVY IN THERE, AND WE DON'T DO THAT ANYMORE. AND SO LAST YEAR IT WENT TO 375 AND THEY TOLD EVERYBODY THAT'S WHAT IT ALWAYS WAS, BUT IT WASN'T. THAT IS, STUFF THAT STAFF CAN IMPROVE ADMINISTRATIVELY AT. JUST THE DECK. THAT'S A PORTION OF THEIR PROJECT IS SUBJECT TO THIS VARIANCE IN TERMS OF EXISTING CONDITIONS. JUST SHOWING YOU THE SIDE OF THE HOUSE THAT THIS DECK WOULD BE PROPOSED OFF OF. WHAT WE'RE LOOKING AT HERE IS THE EXISTING CONDITIONS. THE DECK THAT IS THERE CURRENTLY KIND OF COMING UP CLOSE TO THAT SETBACK LINE OF ABOUT 50FT FROM THE REAR, NOTING THIS FAIRLY SUBSTANTIAL GRADE HERE AS WELL. IN TERMS OF PROPOSED CONDITIONS, WE'RE LOOKING AT A NUMBER OF THINGS. AS I MENTIONED BEFORE, A POOL, LANDSCAPING AND A PATIO AREA AND AN EXPANSION OF THE DECK UP TOP THAT ALSO GOES INTO THAT SETBACK LINE BY ABOUT 10.2FT. SOME RENDERINGS ALSO PROVIDED BY THE APPLICANT IN TERMS OF WHAT THE PROJECT WOULD LOOK LIKE IF EVERYTHING IS PUT IN AS PROPOSED. WHERE STAFF HAD DIFFICULTY ON THIS 1 IS IN REGARDS TO THE PRACTICAL DIFFICULTY CRITERIA. I WILL NOTE THAT THE APPLICATION ITSELF DOES MEET AT LEAST HALF, MAYBE A LITTLE BIT MORE OF THE APPLICABLE VARIANCE CRITERIA. JUST MAINLY NAMING. AND THIS WAS THE BIG POINT MADE BY THE PLANNING COMMISSION LAST WEEK, IS THAT THE 2 ACRE SETBACKS DO CREATE SOME CONSTRAINTS ON THIS PROPERTY WHEN LOOKING FOR A 50 FOOT SETBACK, WHEN AT ONE POINT THE PROPERTY IS ONLY ABOUT 150FT DEEP. IT DOES CREATE SOME CONSTRAINTS FOR AN APPLICANT OR AN OWNER FOR THAT MATTER. STAFF DID NOTE THAT THERE IS A BIT OF CHALLENGING TOPOGRAPHY IN THE REAR SLOPES, UP PRETTY HEAVILY FROM THE BACK OF THE HOUSE AS WELL. [00:15:07] WE DO NOTE THAT THE DECK CAN ALMOST FULLY BE SCREENED BY THE GRADING AND THE LANDSCAPING THAT THEY'RE PROPOSING, JUST SHOWING, ALTHOUGH IT DOESN'T SHOW VERY CLEARLY HERE. SOME OF THE THE TREES THAT ARE IN THE BACKGROUND, THAT IT WILL BE A FAIRLY INTENSIVE PROJECT THAT WILL KIND OF ENCASE A LOT OF THIS YARD SPACE. BUT WHERE STAFF DID NOT FIND THAT THE APPLICATION MET, THE CRITERIA WAS WE IDENTIFIED THAT A CONFORMING BUILDING ENVELOPE REALLY DOES EXIST ON THIS PROPERTY. IT'S JUST BEING COVERED BY OTHER PROPOSED IMPROVEMENTS, SUCH AS A POOL OR PATIO. SO WHEN WE'RE LOOKING AT THIS TYPE OF SPACE. A DECK COULD BE CONSTRUCTED IN THIS AREA AND MEET REQUIREMENTS AND NOT NECESSITATE A VARIANCE. AND IN GENERAL, THAT SIZE INCREASE IN THE SETBACK WASN'T JUSTIFIED IN THE APPLICATION BY PRACTICAL DIFFICULTIES. AND THE FINAL STATEMENT THAT I LEFT THE PLANNING COMMISSION REGARDING THE PRACTICAL DIFFICULTIES IS. ALTHOUGH THE ENVELOPE IS RESTRICTIVE, AMPLE AREA EXISTS TO ALLOW FOR THAT LARGER DECK THAT MEETS SETBACK REQUIREMENTS. TO SUMMARIZE THIS AGAIN IS A REAR SETBACK VARIANCE 10.2FT ENCROACHMENT INTO THE REAR. OUR STAFF HAS NOT RECEIVED ANY PUBLIC COMMENTS ON THIS APPLICATION. OUR STAFF, BASED ON THE PRACTICAL CRITERIA, EVALUATION ON THE PREVIOUS SLIDE RECOMMENDS DENIAL OF THE VARIANCE. HOWEVER, THE PLANNING COMMISSION FELT DIFFERENTLY FOR A COUPLE OF THOSE SUPPORTING BULLET POINTS I PROVIDED. THEIR DISCUSSION WAS REALLY FOCUSED THERE, AND THEY VOTED TO RECOMMEND APPROVAL ON A VOTE OF 5 TO 2.
